TERMS AND CONDITIONS OF ENTRY FOR THE "A TASTE OF HARMONY REGISTER AND WIN! PROMOTION" (PROMOTION)
 
1.    Information on how to enter and prize information form part of these conditions of entry (Conditions of Entry).
 
2.   Entry into the Promotion is deemed to constitute acceptance of these Conditions of Entry.
 
3.   The Promoter is The Scanlon Foundation (Aust.) Pty Ltd ABN 19 623 496 276 of Level 31 Collins Street, Melbourne 3000 (Promoter).
 
4.   Entrants are responsible for ensuring their familiarity with the Conditions of Entry at the time of participation. The Promoter’s decision not to enforce a specific restriction (whether communicated to an entrant or not) does not constitute a waiver of an entitlement to enforce that restriction or of the Conditions of Entry in general.
 
5.   All entrants acknowledge that the Promoter can rely on these Conditions of Entry even if the Promoter only learns of an entrant’s ineligibility after the Promoter has awarded a prize. Return of the prize or payment of its equivalent value to the Promoter may be required by the Promoter in this scenario.
 
6.   The Promoter’s decision in relation to any aspect of these Conditions of Entry and the Promotion is final and binding on each entrant. No correspondence will be entered into.
 
PROMOTION PERIOD
 
7.   The Promotion will commence at 00:01 AEDT on 16/01/2017 and conclude at 23:59 AEDT on 31/03/2017 (Promotion Period).
 
WHO CAN ENTER
 
8.   Entry in the Promotion is only open to Australian residents aged 18 years or older, excluding:
 
(a)          management, employees, directors and contractors of the Promoter, its related entities and other agencies, firms or companies associated with the Promotion (including suppliers of a Prize);
 
(b)          a spouse, de-facto spouse, parent, guardian, child or sibling of a person referred to in paragraph 8(a) of these Conditions of Entry; and
 
(c)          persons who have breached the terms and conditions of any prior promotion run by or on behalf of the Promoter,
 
(Eligible Entrants). The persons referred to in paragraph 8(b) of these Conditions of Entry includes natural and non-natural relations (in the opinion of the Promoter) and the Promoter is responsible for determining whether a person is an Eligible Entrant in its absolute discretion.
 
HOW TO ENTER
 
9.   To enter and be eligible to win, Entrants must, during the Promotion Period:
 
(a)          visit www.tasteofharmony.org.au/register (Promotion Website); and
 
(b)          register an ‘A Taste of Harmony’ event for their workplace (or team within their workplace) by fully completing and submitting the online registration form (Registration Form), providing all the information requested on the Registration Form, including but not limited to:
 
                        i.         their contact name, name of the business they are registering, name of the team they are registering (if applicable), business location, contact phone number, contact person’s business email address, and number of events they are registering;
 
                       ii.         agreeing to hear from the Promoter in the future; and
 
                      iii.         indicating their acceptance of these Conditions of Entry,
 
         (Eligible Entry).
 
10.    An Eligible Entrant will receive a limit of one (1) entry in the prize draw for each Registration Form completed as part of an Eligible Entry. For the avoidance of doubt, if an Eligible Entrant registers more than one (1) event on a single Registration Form, they will only receive one (1) entry in the prize draw.
 
11.    The Promoter is not responsible for any technical difficulties encountered in accessing the Promotion Website. Any costs associated with accessing the Promotion Website are the entrant’s responsibility and are dependent on the internet service provider used.
 
12.    The use of any automated entry software or any other mechanical or electronic means that allows an entrant to automatically enter the Promotion repeatedly is prohibited and will render entries submitted using such means as invalid.
                   
13.    Incomplete, ineligible, indecipherable or incorrect entries (as determined by the Promoter in its absolute discretion) are not eligible to win.
 
14.    Eligible Entries are deemed to be received at the time of receipt into the Promoter's database, not time of transmission by the entrant.
 
VERIFICATION
 
15.      If requested by the Promoter, entrants must produce, within the time stipulated by the Promoter, appropriate photo identification or other documentation required by the Promoter to verify their identity, age, eligibility to enter the Promotion and claim a prize, and compliance with these Conditions of Entry.
 
16.      If the items required by the Promoter are not received or an entrant has not verified to the satisfaction of the Promoter within the time period stipulated by the Promoter, the entry/entries submitted by the entrant will be deemed invalid.
 
17.      A prize will only be awarded following all validation and verification requirements of the Promoter being met to its satisfaction. In the event that the entrant cannot provide suitable verification, the entrant will forfeit the right to a prize (if won) and no substitute will be offered.
 
18.      All costs associated with or arising in connection with the receipt of a prize are the responsibility of the respective prize winner.
 
PRIZE DRAW AND PRIZE INFORMATION
 
19.      A random electronic prize draw will conducted by a representative of the Promoter at Prime Focus, Level 1, 500 Chapel Street, South Yarra, Victoria 3141 (Draw Location) at 12 noon AEST on 06/04/2017 (Prize Draw).
 
20.      The first Eligible Entrant with a valid entry drawn in the Prize Draw will win a trip to Melbourne for two (2) adults, valued at up to $5,000 (including GST) (Major Prize) (see paragraphs 22 – 36 for details).
 
21.      The next Eligible Entrant with a valid entry drawn in the Prize Draw will win a gourmet hamper (hamper at the Promoter’s discretion), valued at up to $150 (including GST) (Minor Prize).
 
MAJOR PRIZE INFORMATION & CONDITIONS
 
22.      The Major Prize includes:
 
(a)      return economy airfares from the Major Prize winner’s nearest Australian state/territory capital city to Melbourne, Victoria, valued up to $2,600 (including GST) (unless the Major Prize winner resides in Victoria, in which instance flights will not be included in the Major Prize);
 
(b)      two (2) nights’ 5-star accommodation at Sofitel Melbourne on Collins (classic room, twin-share) (or similar), valued up to $1,200 (including GST);
 
(c)       return airport/accommodation transfers to in Melbourne, valued up to $300 (including GST);
 
(d)      dinner for two (2) people at Grossi Florentino restaurant, valued at up to $400 (including GST); and
 
(e)       AUD$500 spending money, awarded to the winner only as a VISA card.
 
23.  Flights are not included in the Major Prize if the Major Prize winner resides within Victoria. In this instance the Major Prize winner and nominated companion must make their own way to and from the accommodation at their own expense in order to participate in the Major Prize.
 
24.  The Major Prize must be redeemed/travelled in full by 06/04/2018.
 
25.  The travel arrangements are subject to availability at all times, including the availability of the nominated seat class for airfares, or room type with the accommodation provider. Availability of Major Prize travel dates will also be subject to booking availability at Grossi Florentino restaurant. The Major Prize winner will be required to provide the Promoter with preferred travel date options when requested and travel dates will remain the discretion of the Promoter.
 
26.  Both people travelling the Major Prize must be aged 18 years or older.
 
27.  All aspects of the Major Prize (including travel and accommodation) are for two (2) people travelling together at all times.
 
28.  All components of the Major Prize must be taken together as a single trip as described above and as booked by the Promoter. Once booked, no changes to the booking are permitted.
 
29.  If for any reason the Major Prize winner or nominated companion do not take an element of the Major Prize at the time stipulated by the Promoter, then that element of the Major Prize will be forfeited and no substitute or cash be supplied in lieu of that element of the Major Prize.
 
30.  The Major Prize winner must hold a valid credit card and present it upon check in at the accommodation establishment to cover any incidental costs or other hotel charges not covered as part of the Major Prize.
 
31.  All costs, expenses and charges associated with or arising in connection with the Major Prize which are not expressly incorporated as part of the Major Prize are the sole responsibility of the Major Prize winner and the Promoter accepts no responsibility for such costs, expenses or charges.
 
32.  The Major Prize does not (except as expressly stated) include the following:
 
(a)      any transport between the Major Prize winner’s residence and the departure airport (if applicable);
 
(b)      any overnight accommodation while travelling to the departure airport or destination (if applicable);
 
(c)       any other travel or accommodation;
 
(d)      any incidental hotel charges (such as mini-bar charges, telephone calls, in-house movies, food and beverages);
 
(e)       any insurance (such as travel or health cover), however the Promoter requires the Major Prize winner and their nominated travelling companion to cover themselves with full travel insurance valid for interstate travel (if applicable). Receipt of insurance for all persons travelling must be supplied to the Promoter prior to travel. Should the Major Prize winner and their travelling companion fail to take out travel insurance, the Promoter will require them to sign a waiver prior to travel; and
 
(f)        any other ancillary costs which may be incurred by those travelling.
 
33.  Participation in the Major Prize is subject to such other terms and conditions as may be imposed by those involved in providing the goods or services included in the Major Prize (Third Party Terms). 
 
34.  The Major Prize winner and nominated travelling companion participating in the Major Prize are responsible for compliance with all applicable Third Party Terms and bear all risks associated with failure to comply with any of them. They will be required to maintain an acceptable standard of behavior while a participant in the Major Prize. The Promoter assumes no liability (and will provide no compensation) to the Major Prize winner and/or nominated travelling companion who, as a result of any failure to comply with any Third Party Terms:
 
(a)      is unable to participate in the Major Prize (or any part of it); or
 
(b)      suffers any other loss or damage.
 
35.  As a condition of accepting the Major Prize, the Major Prize winner and companion must sign any legal documentation as and in the form required by the Promoter and/or Major Prize providers in their absolute discretion, including but not limited to a legal release and indemnity form.
 
36.  The Major Prize cannot be sold, scalped, auctioned, raffled, pledged, or promoted as an incentive or reward by any third party as an inducement for any person or other entity to enter into any commercial or other arrangements with that third party. If the Major Prize is obtained through any of these methods, it will not be honoured.
 
NOTIFICATION OF WINNERS
 
37.  Prize winners will be notified by phone and via email, and will subsequently be featured on the Promotion Website from 26/04/2017.
 
UNCLAIMED PRIZE DRAW (IF ANY)
 
38.  If a prize is undeliverable (i.e. a prize winner cannot be located) or a prize is returned to the Promoter by 11:00 AEST on 06/07/2017, a random electronic re-draw will be conducted at 12 noon AEST on that date at the Draw Location by a representative of the Promoter from all remaining Eligible Entries received in the Promotion in order to distribute any unclaimed prize/s, subject to any directions from the relevant gaming departments (Re-Draw).
 
NOTIFICATION OF RE-DRAW WINNER/S (IF ANY)
 
39.  The Re-Draw winner/s (if any) will be notified by phone and via email, and will subsequently be featured on the Promotion Website from 26/07/2017.
 
GENERAL
 
40.  If more than one person attempts to claim a prize, the Promoter has sole and absolute discretion to determine which of those persons is the winner of the prize.
 
41.  The Promoter shall not be liable for a prize being lost, stolen, damaged or tampered with in any way before it reaches the prize winner or after it has been provided to the prize winner.
 
42.  The Promoter accepts no responsibility for any variation in the value of a prize from the time of printing Promotion materials.
 
43.  Prizes are not transferrable, exchangeable or redeemable for cash.
 
44.  If the Promoter is unable to provide a prize winner with the nominated prize (or prize component), the Promoter reserves the right to supply an alternative prize (or prize component) of similar monetary value to the nominated prize, subject to any directions given by relevant state and/or territory regulatory authorities.
 
45.   The Promoter accepts no responsibility for any entries not received for any reason during the Promotion Period. No responsibility will be taken for lost, late or misdirected entries. The Promoter does not warrant that the entry mechanism will be available at all times during the Promotion Period.
 
46.   If, for any reason, the Promotion is not capable of being run as planned, including due to infection by computer virus, bugs, network failure, tampering, unauthorised intervention, fraud or any other causes beyond the control of the Promoter, which corrupt or affect the administration, security, fairness, integrity or proper conduct of the Promotion, the Promoter reserves the right in its absolute discretion to take any action that may be available to it, subject to state/territory law, including cancelling, terminating, modifying or suspending the Promotion.
 
47.  Any entrant who, in the opinion of the Promoter, tampers or interferes with the entry or draw mechanism in any way, engages in any unlawful or improper conduct which jeopardises or is likely to jeopardise the fair or proper conduct of the Promotion, or who does not properly comply with the entry process, will be ineligible to win.
 
48.   The:
 
(a)  Promoter, the Promoter's related entities, and all agencies associated with the Promotion; and
 
(b)   the employees, agents, directors and contractors of all entities,
 
         shall not be liable for any loss or claim, action, demand, liability, damage, cost, expense or personal injury whatsoever (including but not limited to any direct, indirect or consequential loss), incurred, suffered or sustained by any person or entity (without limitation) in connection with, or arising from, the Promotion or the acceptance or use of a prize, except that which cannot be excluded by law (in which case that liability is limited to the maximum extent allowable by law).
 
49.  The Promoter accepts no responsibility whatsoever for any tax liabilities that may arise from winning or receiving the benefit of a prize and independent financial advice should be sought by the respective winner.
 
50.  Prize winners must, at the Promoter's request, participate in any Promotion activity (such as publicity and photography) relating to winning a prize, free of charge, and they consent to the Promoter using their name and image in any future promotional material.
 
   PERSONAL INFORMATION
 
51.  Immediately upon submission by an entrant, any entry becomes the sole property of the Promoter.
 
52.  All information entrants provide (Personal Information) will be used by the Promoter for the purpose of administering this Promotion and contacting and verifying the winners.
 
53.  Should an entrant's Personal Information change during the Promotion Period, it is the entrant's responsibility to notify the Promoter by contacting Emma Fay from Blackbird PR at emma@blackbirdpr.com.au
 
54.  The Promoter may disclose Entrants' Personal Information to its contractors and agents to assist in conducting this Promotion and as required, to Australian regulatory authorities.
 
OPTING-IN TO HEAR FROM THE PROMOTER
 
55.  By registering an event and submitting an Eligible Entry in the Promotion, Entrants understand that the Personal Information provided may be entered into a database and may be used by the Promoter, the Promoter's related entities, and agencies engaged by the Promoter, for the Promoter's current and future promotional and marketing purposes without further reference or compensation to the entrant.
 
56.  Entrants may request to update or correct their Personal Information held by the Promoter and/or may request that they not receive further Promotional or marketing communications from the Promoter at any time by contacting the Promoter at sally@blackbirdpr.com.au or by electing to ‘opt out’ by using the ‘opt out’ function on any electronic marketing materials received.
 
PRIVACY POLICY
 
57.  Entrants may view the Promoter’s privacy policy by visiting www.tasteofharmony.org.au/privacy-policy The privacy policy details how a privacy complaint can be made.
 
58.  The Promoter is bound by the Australian Privacy Principles in the Privacy Act 1988 (as amended by the Privacy Amendment (Enhancing Privacy Protection) Act 2012), as well as any other applicable laws.
